American Immigration Ban and its Impact on India

In the wake of Coronavirus, Donald Trump has decided to impose an immigration ban, barring entry in the US. The new policy puts a halt in the issuance of green cards as well. Complete Coverage: Coronavirus


Crux of the Matter


President Donald Trump confirmed the immigration ban to the USA and said, 1. the ban would protect US citizens from job losses in COVID-19 and, 2. help in preventing the import of Coronavirus from other nations. The US government put a 60-day ban on the issuance of Green cards. It is likely that many immigrants will face problems because of this move.

Who will be affected? Due to the change in the immigration policy, American citizens won’t be able to sponsor a permanent residency to non-American citizen family members above 21 years. Further, the Government has put a halt in issuing Green cards on the basis of temporary employment (H1B and others) and to people entered through EB-1 visas which are for “extraordinary ability category”. Over 2 lakh Indian immigrants are likely to be affected. The situation has been particularly difficult for Indians stranded in the US who cannot come back to India as its borders are temporarily closed. The USA government has assured that people with no control over the situation will get protection from the US government. Tech companies like Google, Facebook, Apple, Microsoft, etc. have come together and appealed the US government to grant relief to foreign-born workers. 

Who will not be affected? But to keep the American economy alive, it feels, persons with EB-5 visas will face no problems. The sole criteria to get an EB-5 visa is that one needs to make a minimum investment of $900,000 and create at least 10 jobs in the USA. Medical professionals (physicians, nurses, or other workers) are exempted. The business visa process of the L-1 and E-2 visas will observe no changes. The existing valid visa holders are immune to the changes in the immigration policy.

Eg: Any person with an intent to make investment of at least $100,000 can get temporary visa under the terms of treaty between both nations.
