
The court issued a black warrant and pronounced that the culprits of the 2012 Nirbhaya Case will be hanged till death on January 22. However, they have a last legal resort: file a mercy plea to the President or file a curative petition.
Crux of the Matter
The four perpetrators, Pawan Gupta, Mukesh, Akshay Singh, and Vinay Sharma, will be hanged till death on 22 January at 7 AM in Tihar Jail.
Supreme Court had dismissed review petitions filed by the four convicts. It had said that it had already taken into consideration all the vexing and appeasing scenarios while sticking to the verdict of death penalty.
The victim’s mother said, “My daughter has got justice. Execution of the four convicts will empower the women of the country. This decision will strengthen the trust of people in the judicial system.” The victim’s father said that “SC’s decision will instill fear in people who commit such crimes.”
Of the six perpetrators, one allegedly killed himself while in jail. While the one, who was juvenile, was sent to a reform facility and released after 3 years.
The four sentenced have the last legal recourse of filing a mercy plea to the President or/and file a curative plea. The lawyers of the sentenced have said they would be filing a curative plea in a day or two.

In the Curative petition, the petitioner is required to aver specifically that the grounds mentioned had been taken in the review petition filed earlier and that it was dismissed by circulation. This has to be certified by a senior advocate. The Curative petition is then circulated to the three senior-most judges and the judges who delivered the impugned judgment, if available.
