SC Upholds Disqualification of 17 Karnataka MLAs

The Supreme Court on 13th November upheld the disqualification of 17 Congress-JDS MLAs but has allowed their plea to contest the by-elections.


Crux of the Matter


  1. Assembly speaker KR Ramesh Kumar had disqualified 17 MLAs of ruling the Congress-JD(S) coalition before the trust vote in July.

  2. A three-judge bench of justices NV Ramana, Sanjiv Khanna and Krishna Murari upheld the disqualification but maintained that the Speaker was not empowered to disqualify the lawmakers for the entire tenure of the term.

  3. The MLAs had quit the Assembly as part of an alleged BJP attempt to bring down the Congress-JDS government.

  4. By-polls for the 15 out of 17 seats is scheduled to take place on the 5th December.
