Vyapam Scam: Court Sentences 10 Years Jail to More than 30 Accused

The Special Judge, CBI, Bhopal, on Monday 25 November 2019, gave jail sentence to 32 accused persons, including candidates, impersonators and middlemen in two Vyapam (Madhya Pradesh Professional Examination Board) related cases.


Crux of the Matter


  1. Pradeep Tyagi, a middleman/mastermind was sentenced to undergo 10 years Rigorous Imprisonment whereas 12 candidates Rajveer Singh @Banti, Arun Gurjar @ Tinku, Mukesh Singh Gurjar, Uday Bhan Singh Gurjar, Ajay Pratap Singh, Bhupendra Singh Tomar, Kalyan Singh Sikharbar, Srinivas Jatav, Prabendra Singh Tomar @ Banti, Gulbir Singh Jath, Atendra Singh Gurjar; 12 impersonators Rahul Pandey @ Rajesh Upadhyay, Asish Kumar Pandey, Kulvijay Verma, Abhishek Katiyar, Suyesh Saxena, Neeraj Mishra, Anil Yadav, Ajay Sekharwar, Dharmesh Singh, Phool Kuwar, Ajit Chowdhury, Chandra Pal Kashyap and 6 other middlemen Satish Sharma, Devendra Singh, Prabhakar Sharma, Shivshankar Harijan, Dinesh Dhakar & Punjab Singh all were sentenced to undergo seven years Rigorous Imprisonment.

  2. CBI had registered this case on the orders of the Supreme Court of India and taken over the investigation of the case on 23 December 2015 from Madhya Pradesh Police. It was alleged that unfair means were used in the Madhya Pradesh Police Constable Recruitment Test-2013 conducted by Madhya Pradesh Professional Examination Board (VYAPAM) involving 12 accused candidates who had arranged and used impersonators through racketeers/ middlemen for passing the written examination of PCRT- 2013.

  3. The Trial Court found all the 31 accused guilty and convicted them under sections 120-B read with 419, 420, 467, 468 & 471 of IPC and section 3(D)(1)(2)/4 MPRE Act 1937.

  4. The Special Judge, CBI, Vyapam Cases, Bhopal also sentenced Beerendra Singh Gurjar, who had appeared as a candidate in the Police Constable Examination 2013 (II) conducted by Madhya Pradesh Professional Examination Board (MP VYAPAM), to undergo seven years rigorous Imprisonment with fine of Rs.7000 in another Vyapam related case.

  5. CBI had registered this case on 5 August 2015 against the accused as per the orders of Supreme Court of India and took over the investigation of the case, earlier registered at Police Station Jehangirabad in Bhopal (Madhya Pradesh).

  6. It was alleged that the accused had cheated by impersonation and forgery in the examination of Police Constable Examination 2013 (II) conducted by Madhya Pradesh Professional Examination Board (MP VYAPAM).

  7. After completion of investigation, CBI filed supplementary charge sheet against the accused candidate, Beerendra Singh Gurjar before the Court of 8th ASJ, Bhopal (MP), on 19 December 2018.

  8. The Trial Court found the accused guilty and convicted him.

Supreme Court of India on 9 July 2015 had ordered the transfer of the Vyapam scam case and investigations into the deaths linked with this case to the Central Bureau of Investigation (CBI). The order had come in response to a petition by Congress general secretary Digvijay Singh and a few whistle blowers who were raising this matter for a long time. The VYAPAM scam involving the Madhya Pradesh State Professional Examination Board revolves around massive irregularities in medical admission tests and recruitment of staff for many state departments, including contractual teachers and transport constables. During the long drawn investigation by CBI, names of certain racketeers, “Solvers and Beneficiary candidates” and several others have surfaced. They were allegedly operating from places like Bhopal, Indore, Ujjain, Shahdol, Ratlam and Sagar. It is alleged that these racketeers were found to be involved in arranging for Beneficiary candidates and Solvers. The pairing of respective Solvers and Beneficiary candidates was being done by the racketeers. It was also alleged that the racketeers thereafter were getting the roll numbers of these Solvers-Beneficiary candidates manipulated through Vyapam (Madhya Pradesh Professional Examination Board) officials, so that the Beneficiary candidate was seated right behind his Solver candidate to enable the Beneficiary to cheat and copy the answers from the Solver candidate.
